Responsibility

The responsibility of Ah Nyar Thar Travels and Tours Company Limited (hereinafter, referred to as Ah Nyar Thar) is strictly limited. As a tour operator, Ah Nyar Thar organizes, promotes, and sells tour programs consisting of certain travel services, including land, air and water transportation, sightseeing excursions, and cruise/hotel accommodations that Ah Nyar Thar purchases or reserves from various suppliers (collectively, "Suppliers"). Ah Nyar Thar does not own or operate any of these Suppliers.

The Suppliers providing travel services for tour programs of Ah Nyar Thar are independent contractors, and are not agents or employees of Ah Nyar Thar. As such, Ah Nyar Thar is not responsible for any negligent or willful act or failure to act of any supplier or of any third party. Some tours include visits to shops and merchants. Ah Nyar Thar is not responsible for any purchases that customers make during their trip, whether that merchant is part of the scheduled itinerary or not. By utilizing the travel services of the Suppliers, you agree that you will look to such Suppliers for any accident, injury, property damage, or personal loss to you or to those traveling with you, and that neither Ah Nyar Thar nor any representative of Ah Nyar Thar shall be liable.

Ah Nyar Thar is not responsible for any injury, loss or damage to person or property, death, delay, or inconvenience in connection with the provision of, or failure to provide, any goods or services occasioned by or resulting from but not limited to – acts of God or forces of nature, acts of war or civil unrest, insurrection or revolt, strikes, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes of other means of transportation or for the failure of any transportation mechanism to arrive or depart on time, sanitation problems, lack of medical care, or for any other cause beyond the direct control of Ah Nyar Thar.

All certificates and other travel documents for tour services issued by Ah Nyar Thar are subject to the terms and conditions specified by the suppliers, and to the laws of Myanmar. If, after tour departure, the services included in the tour cannot be supplied, or there are changes in an itinerary for reasons beyond the control of Ah Nyar Thar, Ah Nyar Thar will arrange for the provision of comparable and best available services. Any resulting additional expense will be payable by travelers and any resulting saving will be refunded by Ah Nyar Thar to tour participants if the tour was booked directly with Ah Nyar Thar; otherwise, clients can ask for the saving, if applicable, from their travel agent.

Children and Infants

Children between 2 and 12 years of age at the time of traveling in Myanmar receive a 25% discount on package tour prices and providing they share the room with two (2) adults without an extra-bed (or 15% discount if they require an extra bed). These discounts are granted for one child per room only. Children requiring their own rooms are charged as adults but get a 30% discount on applicable domestic airfares. Land arrangements for infants under two are free of charge, providing parents pay directly to the hotels for food, crib, etc.

Cancellations and Refunds

If you must cancel your trip, you must do so in writing. Cancellation refunds will be calculated as of the date we receive your written cancellation.

All payments for travel services not provided to the passenger shall be refunded in accordance with these Terms and Conditions and in accordance with cancellation policy of Ah Nyar Thar, unless the passenger otherwise instructs Ah Nyar Thar in writing.

Unless otherwise stated in the proposal, for all cancellations we will refund the cost of your trip less the following per person charges.

The above cancellation charges will be applied in all cases in addition to the cancellations of suppliers, if applicable, such as some hotels in Inle Lake region and beaches in Myanmar. We do urge you to take adequate travel insurance, including cover against cancellation and health as well.

Disabled Travelers

You are to advise us in writing, at time of or prior to booking, of any disability requiring special attention during the trip or may require the use of special equipment. If you fail to disclose any such conditions, Ah Nyar Thar may refuse to allow you to take the trip and you will forfeit the trip cost; and in such event we shall have no liability, financial or otherwise.

Ah Nyar Thar will make reasonable attempts to accommodate the special needs of disabled travelers, but is not responsible in the event it is unable to do so, nor is it responsible for any denial of services by carriers, hotels, restaurants, or other independent suppliers. Most transportation services, including the touring vehicle, in Myanmar are not equipped with wheelchair ramps. We regret that we cannot provide individual assistance to a tour participant for walking, dining, getting on and off vehicle or other personal needs. A qualified and physically able companion must assume total responsibility for the handicapped participant's wellbeing.

We cannot accommodate ladies past their sixth month of pregnancy. If you require a wheelchair, you must provide your own small, collapsible wheelchair. Certain features, and certain trips, are not wheelchair-friendly, for instance an excursion by boat on Inle Lake. We cannot guarantee any wheelchair assistance or accessibility in Myanmar.

Ah Nyar Thar is not responsible for the costs of any medical treatment you may require during the trip. Under no circumstances is Ah Nyar Thar responsible for the quality of medical care, or lack thereof, you may receive while on the trip in Myanmar.

Domestic Air Arrangements

The guests of Ah Nyar Travels & Tours Company Limited will usually travel by reliable Air Bagan and/or Air Mandalay and/or Yangon Airways. The maximum allowed Baggage on domestic flights is limited to 20 kg for all domestic flights in Myanmar. Travelers are to pay for the excess baggage to the respective airline on spot. Otherwise, excess luggage can be left in hotels in Yangon for collection on return from upcountry. Porterage at the airports in Myanmar for one suitcase per person on tour is included in the tour price. All domestic flights in Myanmar are non-smoking.

To provide you with the lowest possible airfares, Ah Nyar Thar takes advantage of special promotional fares. These fares can be quite restrictive and carry cancellation charges imposed by the airlines ranging from 25% to 100%. Therefore, any penalties resulting from flight changes at your request after flights are ticketed will be your responsibility. If you cancel your trip after receiving your tickets, you must return your tickets to Ah Nyar Thar before your refund (if applicable) is processed.

Air routings for the domestic flights in Myanmar are subject to availability. Routings cannot be guaranteed, and are subject to change at any time. Ah Nyar Thar is not responsible if an airline cancels or delays flight or changes the routing. Ah Nyar Thar will not provide any refund for portions of trips missed due to cancelled or delayed flights or changed routing. If an air schedule requires an overnight stay in a destination, Ah Nyar Thar can assist with hotel reservations: however, if a flight requires a layover, overnights are at your expense.

Price Guarantee

All tour prices are quoted net in United States Dollar, based on rates (including foreign exchange rates) known at the time of quotation and expected to be in effect at the time of departure. Prices are subject to increase without notice if such rates change prior to departure. Ah Nyar Thar reserves the right to correct pricing errors at any time, or to increase the program price in the event of cost increases due to changes in airfares, cruise fares, currency fluctuations, entrance fee increases, taxes, or fuel surcharges. However, once Ah Nyar Thar received your deposit for the full tour price, that price is guaranteed, and any subsequent land cost increases are at our expense, not including surcharges and any government tax increases.

Tour prices are per person and include hotel accommodation, transfers, domestic airfares, meals and other services as specified in the respective tour itinerary. Not included in the tour prices are airport tax and fees, passports, visas and vaccination, tips to your tour guide, driver, gratuities on ferries and cruise ships, laundry, beverages, and food not on the regular table d'hôte menu (these extra items will be billed to you before leaving hotel or restaurant), optional excursions, porterage at hotels, travel insurance, excess baggage fees and all other items of a personal nature. Every effort has been made to produce pricing information accurately. We reserve the right to correct errors.

The accommodations listed in the proposal are intended to be used on all tours. However, if a change becomes necessary for any reason, the accommodations substituted will be equivalent in standard to those offered. Clients are advised that accommodation in remote locations can be very basic and simple.

A deposit of 30% of the total tour price per person is required to secure your reservation. To secure reservations on a trip departing within 30 days, a full payment is required by bank remittance at the time of booking. If the tour includes a river cruise, a deposit as specified in the proposal is required to secure your reservation and may be subject to alternate cancellation terms as indicated in the detailed itinerary. Strict cancellation and deposit policies apply for bookings of river cruises, beach hotels and hotels at Inle Lake.

Reservations will be cancelled if final payment is not received by the due date and cancellation charges will apply. Tour prices stated are per person and based on double occupancy. For changes you make to your reservation, a $30 per person administrative charge applies. Changes to departure date may incur cancellation fees. All changes are subject to availability and cannot be guaranteed. If hotel accommodation or domestic flight only is requested, a nominal fee of $30 will be charged. If the file value exceeds $250, this fee will be waived.

Final payment by bank transfer for the tour must be received in full by Ah Nyar Thar 4 weeks prior to the tour arrival in Myanmar. With regard to bank charges/fees, Ah Nyar Thar Travels & Tours Company Limited shall absorb charges levied by our bank, whereas bank charges/fees levied by the sender's bank must be borne by the debtor. Transportation

The guests of Ah Nyar Thar will travel in air-conditioned vehicles for all tours and transfers in Myanmar. However, air-conditioned vehicles may not always be available in some regions, and they should be informed well in advance that the quality of roads varies throughout Myanmar from reasonable to poor. Despite the efforts of upgrading road conditions, long distance overland travel usually takes longer than the traveler might expect and the average speed of travel range between 50 to 60 kilometers per hour. The boat trips might take longer depending on the prevailing weather and river conditions.
